1. About Garuda Drive

Garuda Drive Inc. operates a peer-to-peer car sharing marketplace that connects vehicle owners (“Hosts”) with individuals who wish to rent vehicles (“Renters”). Garuda Drive is a technology platform; we do not own, operate, or control the vehicles listed on the Platform.

2. Eligibility

To use Garuda Drive you must:

• Be at least 21 years of age
• Hold a valid Canadian or internationally recognised driver’s licence
• Provide accurate identity and payment information
• Pass our identity and driving record verification
• Not have been banned from the Platform previously

3. Host Terms

3.1 Listing a Vehicle

• You must be the registered owner of the vehicle or have explicit authorisation to list it
• The vehicle must be roadworthy, legally registered, and insured in the province of operation
• All information provided (VIN, condition, photos) must be accurate and up to date
• You must keep maintenance records current and ensure the vehicle meets all provincial safety standards

3.2 Host Responsibilities

• Provide the vehicle in a clean, fuelled, and roadworthy condition
• Respond to booking requests within 24 hours
• Conduct a vehicle inspection with the Renter at pickup and return
• Report any accidents or damage within 24 hours of the trip ending

3.3 Payouts

Hosts receive 86% of the trip price after Garuda Drive’s 14% service fee. Payouts are processed within 3–5 business days after each trip is completed.

4. Renter Terms

4.1 Booking

• Bookings are confirmed only after payment is successfully processed
• You must present a valid driver’s licence at vehicle pickup
• Only the approved Renter may drive the vehicle unless additional drivers are pre-approved

4.2 Renter Responsibilities

• Return the vehicle on time, with the same fuel level, and in the same condition
• Pay for any traffic violations, tolls, or parking fines incurred during the trip
• Not use the vehicle for commercial purposes, racing, or off-road driving
• Not smoke or transport illegal substances in the vehicle
• Report any accidents or mechanical issues immediately to Garuda Drive

5. Insurance Coverage

Every confirmed trip on Garuda Drive includes:

• $2,000,000 CAD third-party liability coverage
• Collision and comprehensive coverage (subject to a deductible)
• 24/7 roadside assistance across Canada

Coverage is secondary to any personal auto insurance held by the Renter. Full coverage terms are set out in the Garuda Drive Insurance Certificate available on the Platform.

7. Prohibited Uses

• Using the Platform for any illegal purpose
• Providing false information during registration or booking
• Subletting a vehicle to a third party
• Using a vehicle outside of Canada without prior written approval
• Circumventing the Platform to arrange off-platform transactions with Hosts

8. Dispute Resolution

In the event of a dispute between Hosts and Renters, Garuda Drive will act as a neutral mediator. Unresolved disputes may be referred to arbitration under the Arbitration Act of Ontario. Both parties waive the right to a class-action lawsuit against Garuda Drive.

9. Vehicle Condition & Mechanical Disclaimer

• No guarantee of vehicle condition. Garuda Drive makes no representation or warranty, express or implied, as to the condition, roadworthiness, safety, reliability, or fitness of any vehicle listed on the Platform. Vehicle listings are created solely by Hosts.
• Breakdowns & mechanical failures. Garuda Drive is not liable for any loss, inconvenience, cost, injury, or damage arising from a vehicle breakdown, mechanical failure, flat tyre, engine fault, or any other technical defect that occurs during a trip — regardless of whether the defect was pre-existing or arose during the rental period.
• No roadside guarantee. While 24/7 roadside assistance is included with confirmed bookings, Garuda Drive does not guarantee response times or outcomes. Disputes regarding roadside service are between the Renter and the roadside assistance provider.
• Host responsibility. It is the Host’s sole responsibility to ensure their vehicle is in a safe, legal, and roadworthy condition before each trip. Hosts who knowingly list unroadworthy vehicles may be permanently removed from the Platform and held liable.
• Renter acknowledgement. By completing a booking, the Renter acknowledges that they have independently satisfied themselves as to the condition of the vehicle at pickup and accept the vehicle “as is” for the duration of the trip.
• Accidents & third-party incidents. Garuda Drive is not a party to any accident, collision, or road incident that occurs during a trip. All accident claims are handled directly between the Renter, Host, and the applicable insurance provider.

10. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, Garuda Drive’s total liability to you for any claim arising from or related to these Terms or your use of the Platform shall not exceed the greater of (a) the amount you paid to Garuda Drive in the 12 months preceding the claim, or (b) $500 CAD. In no event shall Garuda Drive be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, personal injury, or property damage arising out of or in connection with the use of any vehicle booked through the Platform.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You consent to the exclusive jurisdiction of the courts of Ontario for any disputes.
